musicserve Terms and Conditions

It is important that you read these terms and conditions before selling your items on musicserve, or purchasing items from advertisers on musicserve, or responding to/placing wanted postings.

(Reference to the name "musicserve" refers to musicserve
"Advertisers", "sellers", "individuals" are registered users of musicserve advertising second user, new or unwanted items of musical instruments/machinery.
"Buyers" are registered/non-registered users of musicserve who respond to private advertisements made by users of musicserve.
"Goods", "Items" refer to musical instruments/machinery that are being sold/bought by users of musicserve )

Section 1. Advertising goods and services on musicserve.

All goods advertised on musicserve should be of a musical or music related nature.

All music items sold must be either of a second hand, unwanted gift, new or used status.

musicserve does not allow or encourage the sale of unlawfully purchased/obtained goods. Appropriate action may be taken against any body found doing so.

All items sold must be in working order, unless otherwise stated. musicserve will not be held responsible for the sale or purchase of faulty goods.

musicserve cannot be held responsible for misinformation, or incorrectly advertised goods that may describe an item as something it is not, or lead the reader into believing that the item is different to what it actually is.

musicserve cannot vouch for the integrity and quality of the MP3 uploads. The MP3 uploads may not necessarily relate to the advertiser.

It is strictly forbidden to upload copyrighted material in the form of MP3 or pictures. musicserve holds no responsibility for copyrighted material.

We recommend that any produced music or imagry is copyrighted prior to upload to musicserve. musicserve is not responsible for the distribution of your music and pictures once online.

musicserve makes no guarantees for the responses you may receive from placing an advert or request for equipment or services from musicserve users.

musicserve makes no guarantees that a MAX advert will be emailed out. There is a small chance that there will be no subscribers looking for that particular item or service.

musicserve has the right to edit, ammend, delete and remove private advertisements, or parts of private advertisements, if found to be offensive, inappropriate, misleading or otherwise. musicserve does not have to inform the advertiser of any ammendments made to the advertisement.

musicserve strictly forbids the sale of pirate CD / vinyl compilations or pirated music of any description. All items sold must be genuine items.

musicserve has the right to remove advertisements.

musicserve will not make any charge, or related charge to advertisers to post private advertisements.

musicserve has no involvement in the sale, distribution or posting of items advertised. This is the sole responsibility of the advertiser.

Unless specified on the sign up form, musicserve has the right to distribute user information to companies for their own purposes. musicserve will not distribute user information to companies deemed to be irresponsible, non-politically correct, of questionable integrity, or potentially offensive/harmful to the environment.

musicserve is not responsible for the way in which personal information is used by readers of the advertisements. musicserve cannot be held responsible for concequences that may arise from the publication of this information.

musicserve cannot be held liable for the integrity of the buyer of goods advertised (this includes loss of goods, credit terms/problems arising from the sale, non-payment for goods sold on musicserve).

Refunds will be given at the discretion of the Company Management.

Section 2. Responding to advertisements on musicserve.
(where applicable, statements made in section 1 of these terms and conditions, apply to section 2)

musicserve offers a free service to individuals wanting to advertise their used audio equipment and services. musicserve will only provide contact information where applicable and details of the item/s for sale. musicserve cannot be responsible for any of the following and related factors:

• The quality of goods purchased from advertisers on musicserve (including fitness of purpose, functionallity and working order)
• Assisting advertisers or buyers in the sale, distribution or posting of goods.
• Repairing/fixing or ammending goods purchased.
• Bogus advertisements, or credit problems arising from the purchase of goods from musicserve.
